Terms and conditions of Edge Publishing Group
eGateway online payment service
1. Service
We will provide the eGateway online payment service (the Service)
on the Edge Publishing Group website (www.edgepubs.com.au) (the
Website) for use by customers on the following
terms and conditions.
2. Accepted cards
We accept MasterCard, Visa and most EFT cards (Cards)
for orders made from the Website.
3. Cards confirmation/rejection
3.1 Card payment confirmation or rejection is not directly
handled by Edge Publishing Group.
3.2 Contact your Card provider if you have any problems using
your Card on the Website. We are not responsible for your
financial institution delaying or denying a payment.
3.3 In the event of a Card payment being declined, you will
be responsible for any additional fees and charges levied
on us by your financial institution.
4. Unauthorised transactions
4.1 If you believe a Service transaction is incorrect or unauthorised,
you must immediately notify us in writing. If we are unable
to settle your complaint, we will advise you of the procedures
for further investigation and resolution, and may request
further relevant details from you.
4.2 If we are unable to resolve a dispute about a Card transaction,
you are required to contact the issuer of the Card so as to
utilise its dispute resolution process.
5. Bookings and Orders
5.1 You may ordinarily make bookings or place orders 24 hours
a day 7 days a week. We will not be liable to you for any
interruptions to the Service.
5.2 Every time you make an online payment using the Service,
you will provide your Card details and other details as requested.
5.3 For all online payment transactions, we shall not record
or maintain a copy of your Card details.
5.4 Payment in full is required before delivery of products
or services booked or ordered on the Website.
5.5 A payment confirmation receipt, or a notification of the
transaction being declined, as the case may be, will be issued
and e-mailed to your nominated e-mail address.
6. Order amendments and cancellations
6.1 Subject to clause 7, you may amend or cancel a booking
or order online.
6.2 Refunds to your Card for cancelled bookings and orders
will be made in accordance with our Refunds and Returns Policy
set out in clause 7.
7. Refunds and Returns Policy
7.1 The following cancellation fees apply and will be deducted
from your refund to cover our administrative fees and applicable
banking fees and charges with respect to cancellations of
booked services or product orders:
7.1.3 In relation to cancelling a placed order for a product:
a) Edge Publishing Group undertakes to replace any inherently
faulty or damaged product at no charge to you, provided the
fault or damage was not caused after delivery to you.
b) Any product which is incorrectly delivered due to the fault
of Edge Publishing Group will be either replaced with the correct
item at no charge or the full cost of the item will be refunded.
c) The cost of any products ordered incorrectly by you will
be refunded if Edge Publishing Group is informed within 14 days
of dispatch of the item and the item is returned unopened
and undamaged.
d) The refund will not include the initial postage cost, the
return postage cost and a 5% (of the product cost) refund
administration charge.
8. Warranties and Indemnities
8.1 To the full extent permitted by law, all conditions and
warranties, express or implied, in respect of the Service
are excluded. Our liability in respect of any condition
or warranty that is implied into these terms by applicable
legislation shall be limited, at our discretion, to:
a) in the case of products, the replacement of the products
or the supply of equivalent products; the payment of the cost
of replacing the products or of acquiring equivalent products;
or
b) in the case of services, the supplying of services again;
or the payment of the cost of having services supplied again.
8.2 We are not liable for, and you unconditionally release
us from, any loss or damage whatsoever, including without
limitation economic loss, loss of data, savings, business,
profit, or any other direct, indirect, special or consequential
damage, in each case whether arising from negligence, breach
of contract, breach of statutory duty or otherwise which is
in any way connected with or arises out of your use of the
Service.
8.3 We will not be liable for any delay or failure to perform
our obligations if such delay or failure arises from an event
or circumstances beyond our reasonable control, including
without limitation strikes, lockouts, riots, acts of war or
terrorism, epidemics, earthquakes, fire, floods, government
action, communication line failures, power failures, interruptions
or shortages, computer or processing systems failures, or
some intentional or negligent act of a third party.
9. Privacy
The Privacy Act 1988 (Cth) applies to aspects of our operation
of the Service, including the collection and handling of personal
information. Please refer to our Privacy Statement on the
Website for more details on how we collect and handle personal
information.
10. Changes to these terms and conditions
We may amend these terms and conditions at any time without
prior notice to you. The updated terms and conditions from
time to time will be available on the Website. Your
continued use of the Service after any amendment shall be
taken to be acceptance of the amended terms and conditions.
It is your responsibility to read these terms and conditions
prior to using the Service.
11. Termination
11.1 These terms and conditions shall remain in effect until
we terminate the Service.
11.2 We may terminate or suspend the Service, or your use
of the Service, for any reason at any time.
12. Waiver
We shall not be deemed to have waived any of our rights or
remedies under these terms and conditions unless such waiver
is in writing and signed by one of our authorised officers.
No delay or omission on our part in exercising any rights
or remedies shall operate as a waiver of such rights or remedies.
13. Severance
If any clause or part of any clause is in any way unenforceable,
invalid or illegal, it is to be read down so as to be enforceable,
valid and legal. If this is not possible, the clause (or wherever
possible, the offending part) is to be severed from this agreement
without affecting the enforceability, validity or legality
of the remaining clauses (or parts of those clauses) which
will continue to be in full force and effect.
14. Entire Agreement
These terms and conditions constitute the entire agreement
and understanding between you and us and supersede any and
all prior communications, representations, agreements or understandings
between you and us with respect to the subject matter of these
terms and conditions.
15. Governing Law
This agreement will be governed by and construed in accordance
with the laws of the State of New South Wales, Australia.
The parties submit to the non-exclusive jurisdiction of the
Courts of New South Wales in relation to any dispute or matter
in respect of the Service.
PRIVACY POLICY
Information Collection and Use
Edge Publishing Group is the
sole owner of the information collected on this site. We will
not sell, share, or rent this information to others in ways
different from what is disclosed in this statement.
Log Files
We use IP addresses to analyse
trends, administer the site, track user's movement, and gather
broad demographic information for aggregate use. IP addresses
are not linked to personally identifiable information.

COMPETITION TERMS AND CONDITIONS
1. Entry is open to Australian and New Zealand
residents only. Employees of the promoter and its agencies
associated with the competition, and their immediate families,
are not eligible to enter.
2. Instructions on 'How
to Enter' form part of these conditions of entry. To enter
tell us in 25 words or less why you’d love a Gwinganna
weekend away.
3. You must subscribe to
Spa Life to be eligible to enter.
4. Enter as often as you
wish. There is a limit of one prize per subscriber. No responsibility
is accepted for late entries.
5. The competition commences on the 16-12-2007
at 9.00am. Entries close on 28-02-2008 at 11.59pm.
6. Judging will take place at 9am on the 01-03-2008
at Edge Custom Media, 51 Whistler St, Manly NSW 2095. The
Winner's details will be placed in issue 18 of Spa Life.
7. This is a competition of merit. The best
entry will win. The judge’s decision is final and no
correspondence will be entered into.
8. The prize includes two nights’ accommodation
at Gwinganna Lifestyle Retreat valued at $1880. Five runner
up prizes include the Gwinganna From Garden to Gourmet: Organic
Recipes For Life book valued at $60 each. Total prize pool
is worth $2180. The value of this prize is correct as at
time of printing.
9. The prize is not transferable or exchangeable
and cannot be sold or be redeemed for cash. Any change in
value of the prize occurring between competition date and
the date the prize is claimed is not the responsibility of
